(1) Before cancelling a permit, a relevant decision-maker must (a) give written notice to the permit holder of the relevant decision-makers intention to cancel the permit and the proposed grounds for doing so; and(b) invite the permit holder to make a submission about the proposed cancellation to the relevant decision-maker within the specified period; and(c) take into account any submission made to the relevant decision-maker by the permit holder before the deadline for the making of a submission.(2) For the purposes of subsection (1)(b) , the specified period is not to be a period that is less than 28 days from the date the notice is given to the permit holder under that subsection.(3) The relevant decision-maker is not required to give notice under this section of a proposed cancellation if (a) the permit is a group permit; or(b) the permit is suspended and either (i) the permit holder was given an opportunity to make a submission about the suspension before the suspension took effect; or(ii) the permit holder was given an opportunity to make a submission about the suspension after the suspension took effect, and the period specified by the relevant decision-maker for making that submission has ended.
