(1) A relevant officer, other than the Secretary, Chief Plant Protection Officer or Chief Veterinary Officer, must not, under this Division (a) direct the destruction of a protected plant within the meaning of the Nature Conservation Act 2002 ; or(b) direct the destruction of an organism that is a threatened species within the meaning of the Threatened Species Protection Act 1995 ; or(c) direct the destruction of a relic within the meaning of the Aboriginal Heritage Act 1975 .(2) Subsection (1) does not limit the functions of a relevant officer to do a thing where that action is expressly authorised or required by an emergency order, a control order or the regulations.
