(1) The Secretary may, by proceedings in any court of competent jurisdiction, recover as a debt due and owing any unpaid amount owed under a cost recovery order after the date has passed for payment specified in that order for that amount.(2) If this Act confers on a person a right to appeal to the Appeal Tribunal against the decision to issue a cost recovery order, the Secretary is not to institute proceedings under this section in respect of the cost recovery order unless (a) the period during which the appeal may be made has elapsed; and(b) if the person has made an appeal against the decision, the appeal has been determined or withdrawn.
