(1) In this section known to be Aboriginal or Torres Strait Islander , in relation to a person, means that the person (a) is of Aboriginal or Torres Strait Islander descent; and(b) identifies as Aboriginal or Torres Strait Islander; and(c) is accepted as Aboriginal by a recognised Aboriginal organisation or as a Torres Strait Islander by a recognised Torres Strait Islander organisation.(2) The Governor may appoint a person (a) as the Independent Regulator; and(b) as the Deputy Independent Regulator.(3) If the Governor appoints a person under each of subsection (2)(a) and (b) , the Governor is to ensure that at least one of the persons so appointed, at any one time, is known to be Aboriginal or Torres Strait Islander.(4) Schedule 4 has effect in respect of an appointment made under subsection (2) .
