ELECTRICITY INDUSTRY SAFETY AND ADMINISTRATION ACT 1997 (NO. 72 OF 1997) - SECT 78

Rights of appeal

(1)  A person who is directly affected by a decision of the Regulator may, within 30 days after receiving notice of the decision, appeal to the Board against that decision.
(2)  An appeal is commenced –
(a) by giving the Regulator written notice of the appeal –
(i) identifying the decision under appeal; and
(ii) stating the grounds of appeal and the relief sought; and
(b) paying to the Regulator the prescribed fee.
(3)  On receipt of the notice of appeal, the Regulator must forward the notice to the Minister who must then constitute the Board for the purpose of hearing the appeal.
(4)  An appeal is in the nature of a rehearing and is not limited to matters raised before the Regulator.
(5)  If an appeal has been or is to be commenced, the Regulator or the Board may stay the operation of a decision until the appeal is determined or withdrawn.
