ELECTRICITY INDUSTRY SAFETY AND ADMINISTRATION ACT 1997 (NO. 72 OF 1997) - SECT 79

Procedures on appeal

(1)  The Board is not bound by the rules of evidence but may inform itself as it thinks fit.
(2)  The Board must give the appellant and the Regulator a reasonable opportunity to give evidence and make representations relevant to the subject matter of the appeal.
(3)  The Board may take into consideration and act on the basis of oral or written evidence or representations.
(4)  The Board must conduct its proceedings in public unless the Board considers it in the public interest or in the interests of justice to hear evidence or representations in private.
(5)  The Board must proceed with as little formality and technicality and with as much expedition as the proper consideration of the matter before it permits.
(6)  A party to an appeal may appear before the Board personally or by representative.
(7)  The Board may proceed with an appeal in the absence of a party if satisfied that the party has been given reasonable notice of the date, time and place of the hearing.
