SCHEDULE 2 - Constitution and membership of Electrical Appeals Board

Section 77

1.    Membership panel
(1) The Minister may establish a panel of persons who are, in the Minister's opinion, qualified by their experience in the electricity industry, in law or public administration to be members of the Board.
(2) Each member of the panel –
(a) is to be appointed by the Minister for a term not exceeding 3 years stated in the instrument of appointment; and
(b) is entitled to be paid remuneration and travelling allowances from time to time fixed by the Minister in respect of that member; and
(c) is not, as a member of the panel, subject to the Tasmanian State Service Act 1984 .
(3) A member of the panel is eligible for reappointment at the end of a term of appointment.
(4) A member of the panel –
(a) may resign by written notice to the Minister; and
(b) may be removed by the Minister for incapacity or misbehaviour.
(5) If the term of appointment of a member expires when the member is engaged in the hearing of a matter, the term of appointment is taken to continue until the matter has been finally determined.
2.    Constitution of the Board
(1) When an appeal is commenced, the Minister is to select one or 2 members of the membership panel to constitute the Board for the purposes of the appeal.
(2) The Board, separately constituted under this section, may sit at the same time to hear different appeals.
