NEIGHBOURHOOD DISPUTES ABOUT PLANTS ACT 2017 (NO. 32 OF 2017) - SECT 4

Meaning of plant and plant situated on land
(1)  In this Act –
plant means any plant or part of a plant.
(2)  In this Act, plant includes –
(a) a tree; and
(b) a hedge or group of plants; and
(c) fruits, seeds, leaves, or flowers, of a plant; and
(d) a bare trunk; and
(e) a stump rooted in land; and
(f) any root of a plant; and
(g) a dead plant.
(3)  Despite subsections (1) and (2) , plant does not include a member of a class of plants that is prescribed to be a class of plants to which this Act does not apply.
(4)  For the purposes of this Act, a plant is situated on land if –
(a) the base of the trunk of the plant; or
(b) a place at which a stem of the plant connects with the roots of the plant –
is, or was, situated in whole or in part on the land.
