(1) In this section relevant person means (a) the Minister; or(b) a person appointed, or approved, by the Minister for the purposes of this section.(2) After receiving an election to transfer made by an eligible employee under section 5(1) , the Minister is to ensure that a relevant person consults with the eligible employee in respect of the transfer of the eligible employee, under this Act, to the Department.(3) A consultation under subsection (2) may be held in such manner as the relevant person, conducting the consultation, considers appropriate in the circumstances.(4) Persons present at a consultation with an eligible employee under subsection (2) may include, but are not limited to, the following persons:(a) the eligible employee;(b) the relevant person conducting the consultation;(c) a representative of the former employer;(d) a representative of, or support person for, the eligible employee;(e) if requested by the eligible employee, a representative of an organisation, which protects the rights of workers, of which the eligible employee is a member.
