After section 89 of the Principal Act , the following section is inserted in Part 11:

89A.     Savings and transitional on commencement of Part 6 of the Residential Building (Miscellaneous Consumer Protection Amendments) Act 2023

(1)  The amendments made to this Act by the Residential Building (Miscellaneous Consumer Protection Amendments) Act 2023 do not apply in respect of a residential building work contract entered into before 1 January 2017.

(2)  For the avoidance of doubt, this Act, as in force immediately before the commencement of Part 6 of the Residential Building (Miscellaneous Consumer Protection Amendments) Act 2023 , applies in respect of a residential building work contract entered into before 1 January 2017.
