(1) An owner may serve on the building contractor a work-completion claim in relation to a residential building work contract.(2) A work-completion claim in relation to a residential building work contract may only be served on a building contractor by an owner if the owner is of the opinion that (a) residential building work that was required by the contract to be completed within a period, or by a day, specified in, or determined under, the contract, has not been satisfactorily completed within that period or by that day; or(b) residential building work, to which the contract relates, that was not required by the contract to be completed within a period, or by a day, specified in, or determined under, the contract, has not been satisfactorily completed within a reasonable period.(3) For the purposes of subsection (2) , a period, or a day, within which, or by which, residential building work is required to be completed may be (a) a period by the end of which, or a day by which, a stage of the residential building work is required to be completed; or(b) the date of practical completion in respect of the residential building work contract under which the work is required to be performed.
