(1) This section applies if the tenant under a retail lease does not have an option under the lease to renew the lease for a further term.(2) A landlord must, at least 4 months but no more than 6 months before the expiry of a retail lease, give written notice to the tenant (a) offering the tenant a renewal or extension of the retail lease on the terms (including terms as to rent) and conditions specified in the notice; or(b) informing the tenant that the landlord does not propose to offer the tenant a renewal or extension of the retail lease.(3) An offer made to a tenant under subsection (2)(a) cannot be revoked by the landlord until 60 days after the offer is made.(4) Within 60 days after an offer is made to a tenant under subsection (2)(a) , the tenant must give the landlord written notice of whether or not the tenant accepts the landlords offer.
