Section 14A of the Principal Act is repealed and the following section is substituted:14A. Hire and drive vehicles
(1) In this section,passenger includes driver.(2) When a vehicle is registered, or its registration is renewed or transferred, it is to be registered as a hire and drive vehicle if the registering authority is satisfied that (a) it has been designed and constructed primarily for the purpose of carrying passengers; and(b) it is to be hired out for reward without a driver; and(c) the vehicle is roadworthy and suitable for the purpose of being hired out for reward without a driver.(3) A vehicle may be registered as a hire and drive vehicle at any other time on the application of its owner if it would have to be so registered in the circumstances referred to in subsection (2) .(4) A person (in this subsection called " the proprietor " ) must not hire out a vehicle that has been designed and constructed primarily for the carriage of passengers and is to be driven by a person, other than the proprietor or the proprietor's servant, primarily for the purpose of carrying passengers unless that vehicle is registered as a hire and drive vehicle.Penalty: In the case of .(a) a first offence - a fine not exceeding 100 penalty units; and(b) a second or subsequent offence - a fine not exceeding 200 penalty units.(5) Subsection (4) does not apply to (a) the letting of a vehicle under a hire-purchase agreement made in good faith for the purchase of that vehicle; or(b) the hiring out of a vehicle that (i) has been designed and constructed primarily for the purpose of carrying passengers; and(ii) is authorised to be hired out for reward, without a driver, under a law of a Territory or another State.
