(1) Each regulated entity is required to pay to the Regulator the Regulator's costs incurred in connection with carrying out the Regulator's functions and exercising the Regulator's powers under this Act in relation to the regulated entity, including the costs of –except as otherwise required under this Act.(a) making a determination in connection with the provision of regulated services; and(b) approving a price and service plan submitted by the regulated entity for approval by the Regulator; and(c) approving a customer contract submitted by the regulated entity; and(d) carrying out audits under sections 71 and 72 ; and(e) any other matter related to the regulated entity –(2) If a regulated entity fails to pay the Regulator's costs referred to in subsection (1) , the Regulator may recover those costs from the regulated entity in a court of competent jurisdiction as a debt due to the Regulator.(3) Without limitation, a licence may include conditions relating to the determination of the cost of performing the Regulator's functions and exercising the Regulator's powers.
