CONSUMER CREDIT (TASMANIA) (TRANSITIONAL) REGULATIONS 1997 (S.R. 1997, NO. 14) - REG 4

Application of certain provisions of Part 11 of Consumer Credit (Tasmania) Regulations

(1)  For the purposes of the application of Part 11 of the Consumer Credit (Tasmania) Regulations to a particular credit provider –
(a) where a provision of that Part contains a reference to the commencement of the Code and there is in force an order under sections 5 and 6 of the Act in respect of that credit provider, that reference is taken to be a reference to the date on which that order takes effect; or
(b) where a provision of that Part contains a reference to the commencement of the Code and there is no such order in force, that reference is taken to be a reference to 1 March 1997.
(2)  This regulation does not derogate from the application of the Code or the Consumer Credit (Tasmania) Regulations as a law of Tasmania under section 2 of the Act and section 2 of the Code.

These regulations provide for the application of certain provisions of Part 11 of the Consumer Credit (Tasmania) Regulations in view of the different dates when the Consumer Credit (Tasmania) Code and those Regulations apply to particular credit providers.
