(1)  This regulation applies if –

(a) an application for an approval is referred to the CAP under regulation 187(1) ; and

(b) the CAP decides –

(i) that the approval is to be given, what the terms of the approval is to be, and that the approval is to have effect in all participating jurisdictions or participating jurisdictions including this jurisdiction; or

(ii) that the approval is not to have effect in this jurisdiction.

(2)  The Competent Authority must have regard to the CAP’s decision.
