EXPLOSIVES REGULATIONS 2012 (S.R. 2012, NO. 128) - REG 52

Cancellation of endorsements
(1)  This regulation applies to a shot-firing permit with more than one endorsement.
(2)  The Secretary, by notice to the holder of a shot-firing permit, may cancel any of the endorsements if the Secretary believes on reasonable grounds that –
(a) the holder of the permit no longer requires that particular endorsement or can no longer demonstrate a legitimate need for it; or
(b) the conditions of the permit have been contravened in a material or sustained way as regards that particular endorsement; or
(c) there is other compelling justification for the cancellation.
(3)  However, the Secretary's power under this regulation is not capable of being exercised so as to cancel every endorsement on a shot-firing permit.
(4)  The cancellation of an endorsement on a shot-firing permit under this regulation takes effect when the holder of the permit is notified of it or at a later time specified in the notice.
(5)  The notice is to inform the holder of the permit of –
(a) the cancellation of the endorsement; and
(b) the reasons for the cancellation; and
(c) when the cancellation takes effect; and
(d) the right of review.
