Regulation 10 of the Principal Regulations is rescinded and the following regulation is substituted:

10.     Exemption

(1)  Building work performed by, for or on behalf of an owner-builder is exempt from the application of section 11 of the Act.

(2)  Building work performed by, for or on behalf of the Crown is exempt from the application of section 11 of the Act.

(3)  Building work performed by, for or on behalf of a builder is exempt from the application of section 11 of the Act if –

(a) the builder has entered into an agreement in respect of housing indemnity with the Master Builders' Association of Tasmania; and

(b) before entering into that agreement the Master Builders' Association of Tasmania has consulted with the Minister in relation to that agreement.

These regulations amend the Housing Indemnity Regulations 1993 by exempting certain builders from the application of Division 1 of Part 3 of the Housing Indemnity Act 1992 .
