JURIES AMENDMENT REGULATIONS 2008 (S.R. 2008, NO. 39) - REG 5

Regulation 5 amended (Prescribed remuneration for employed or self-employed jurors)
Regulation 5 of the Principal Regulations is amended as follows:
(a) by omitting from subregulation (1) "salary or wages," twice occurring and substituting "salary, wages or income," ;
(b) by omitting from subregulation (1) "$80" and substituting "the remuneration specified in subregulation (7)" ;
(c) by omitting from subregulation (2)(a) "salary or wages," and substituting "salary, wages or income," ;
(d) by omitting from subregulation (3)(a) "salary or wages," and substituting "salary, wages or income," ;
(e) by inserting in subregulation (3)(b) "loss of income or other" after "suffered" ;
(f) by omitting from subregulation (4) "salary or wages," and substituting "salary, wages or income," ;
(g) by omitting from subregulation (4) "salary or wages" second occurring and substituting "salary, wages or income, or other monetary loss," ;
(h) by omitting from subregulation (4) "$80" and substituting "the remuneration specified in subregulation (7)" ;
(i) by inserting the following subregulations after subregulation (6) :
(7)  For the purpose of subregulations (1) and (4) the specified remuneration is –
(a) $176 for the period 7 July 2008 to 30 June 2009, inclusive of those days; and
(b) for the financial year commencing on 1 July 2009 and for each subsequent financial year, the remuneration calculated in accordance with the following formula:

where –
R is the specified remuneration for a financial year;
A is the average weekly earnings for February in the financial year that immediately precedes the financial year in which the specified remuneration is to apply;
B is the average weekly earnings for February in 2008.
(8)  In subregulation (7) –
average weekly earnings means the seasonally adjusted average weekly total earnings for a full-time adult employee in Australia as published by the Australian Bureau of Statistics.

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Juries Regulations 2005 by –
(a) increasing the remuneration to be paid to unemployed persons who attend court for jury service; and
(b) increasing, and indexing annually, the remuneration to be paid to employed or self-employed persons who attend court for jury service.
