(1) In this regulation minimum number , of qualified crew for a vessel that is carrying passengers, means (a) at least 2 (or, where the master is the only crewmember, one) if the number of passengers does not exceed 40; and(b) at least 3 if the number of passengers exceeds 40 but does not exceed 100; and(c) at least 4 if the number of passengers exceeds 100 but does not exceed 180; and(d) an approved number (no lower than 4) if the number of passengers exceeds 180;qualified crew means those members of a vessel's crew who hold (a) a Certificate of Elements of Shipboard Safety as defined in the NSCV Part D Annex D4 or a qualification that MAST determines to be the equivalent of that certificate; and(b) a first aid qualification as defined in the NSCV Part D Annex D2 or a qualification that MAST determines to be the equivalent of those first aid qualifications.(2) The owner of a vessel must not cause or allow the vessel to operate with passengers on board unless the minimum number of qualified crew are also on board the vessel at the same time.Penalty: Fine not exceeding 50 penalty units.
