POISONS REGULATIONS 2018 (S.R. 2018, NO. 79) - REG 23

Emergency prescribing and dispensing of narcotic substances
(1)  Notwithstanding regulation 16(2) , a pharmaceutical chemist may supply a narcotic substance on the instruction of a medical practitioner, veterinary surgeon, dentist, authorised health professional or authorised nurse practitioner if, because of the urgent circumstances in which the substance is required, it is impracticable, before the substance is required to be supplied, to –
(a) issue a prescription for the substance; and
(b) cause the prescription to be delivered to the chemist.
(2)  A medical practitioner, veterinary surgeon, dentist, authorised health professional or authorised nurse practitioner who issues an instruction under subregulation (1) to a pharmaceutical chemist must send to that chemist, within 5 days of issuing the instruction, a prescription that –
(a) complies with regulation 20(7) ; and
(b) clearly states that it is in confirmation of the instruction to that chemist to supply the narcotic substance without a prescription.
Penalty:  Fine not exceeding 10 penalty units.
