(1)  In this regulation –

existing operator means a person –

(a) who is, by virtue of the operation of section 175(1) of the Act, a person accredited as a railway operator; and

(b) whose accreditation has not been revoked.

(2)  Regulations 9 , 10 , 11 and 16 do not apply to an existing operator until 12 months after the day on which this regulation commences.

(3)  Regulation 20 and regulation 21 do not apply to an existing operator until 3 years after the day on which this regulation commences.
