(1) A person has the status of a learner driver in relation to the driving of motor vehicles for which a driver licence of a particular class is required unless and the Registrar recognises that progression for the purposes of these regulations.(a) the person successfully completes (i) any training course required by the Registrar for progressing beyond that status; and(ii) any other theoretical and practical requirements for progressing beyond that status determined by the Registrar; or(b) the person successfully completes (i) any training course required under a corresponding law for progressing beyond that status; and(ii) any other theoretical and practical requirements for progressing beyond that status under a corresponding law (2) A person who has progressed beyond the status of a learner driver in relation to the driving of motor vehicles for which a driver licence of a particular class is required reverts to that status if (a) the person has not held an Australian driver licence of the relevant class for the past 5 years; or(b) an Australian driver licence, including a provisional licence, of the relevant class has been cancelled and the Registrar decides, on an application for the issue of a driver licence, that the licence is to be issued as a learner licence; or(c) in the case of a novice rider, he or she has been regressed under section 13A of the Act from the P1 stage to the motor cycle learner stage; or(d) in the case of a novice driver, he or she has been regressed under section 13A of the Act from the P1 stage to the L2 stage.(3) A person who progresses beyond the status of a learner driver in relation to the driving of motor vehicles for which a driver licence of a particular class is required has the status of a learner driver in relation to the driving of motor vehicles for which a driver licence of some other class is required (unless the other class is a lower class in the hierarchy of licence classes).(4) A person is taken to have progressed beyond the status of a learner driver in relation to the driving of motor vehicles of a particular class if the Registrar determines that, in view of the person's experience in driving motor vehicles of the relevant class, the person should not be regarded as a learner driver.
