(1) This regulation applies if a person conducting a business or undertaking at a workplace is authorised under regulation 384 to use, handle or store a prohibited carcinogen or restricted carcinogen at the workplace.(2) The person must (a) record the full name, date of birth and address of each worker likely to be exposed to the prohibited carcinogen or restricted carcinogen during the period of authorisation; and(b) keep a copy of each authorisation given to the person including any conditions imposed on the authorisation.Penalty: In the case of (a) an individual, a fine not exceeding $3 600; or(b) a body corporate, a fine not exceeding $18 000.(3) The person must keep the records for 30 years after the authorisation ends.Penalty: In the case of (a) an individual, a fine not exceeding $3 600; or(b) a body corporate, a fine not exceeding $18 000.
