After regulation 5 of the Principal Regulations , the following regulations are inserted:

6.     Prescribed officers in section 135A of Act

For the purposes of the section 135A(1) of the Act, the following persons are prescribed officers:

(a) the Commissioner for Children and Young People;

(b) the Custodial Inspector.

7.     Prescribed Acts in section 135A(2) of Act

(1)  For the purposes of section 135A(2)(a) of the Act, the following Acts are prescribed Acts:

(a) Commissioner for Children and Young People Act 2016 ;

(b) Custodial Inspector Act 2016 .

(2)  For the purposes of section 135A(2)(b) of the Act, the following Acts are prescribed Acts:

(a) Commissioner for Children and Young People Act 2016 ;

(b) Custodial Inspector Act 2016 .

EXPLANATORY NOTE

(This note is not part of the regulation)

These regulations amend the Youth Justice Regulations 2009 to –

(a) prescribe the following persons as prescribed officers for the purposes of section 135A(1) of the Youth Justice Act 1997 :

(i) the Commissioner for Children and Young People appointed and holding office under the Commissioner for Children and Young People Act 2016 ;

(ii) the Custodial Inspector appointed under section 5 of the Custodial Inspector Act 2016 ; and

(b) prescribe the following Acts as prescribed Acts for the purposes of section 135A(2)(a) and section 135A(2)(b) of the Youth Justice Act 1997 :

(i) the Commissioner for Children and Young People Act 2016 ;

(ii) the Custodial Inspector Act 2016 .
