PAROCHIAL CHURCH SCHOOLS ACT 1988
ESTABLISHMENT AND CONSTITUTION
OF PAROCHIAL CHURCH
SCHOOLS
1. The Council of the Diocese shall at its first meeting after the first Session of every future Synod appoint three Clergymen and three Lay Members of the Church to be together with the Bishop as Chairman the Board of Education for the Diocese Four members of the Board shall form a quorum.
2. The Council of the Diocese shall have power to remove any Member of the Board on account of absence from the Diocese or inability or failure to attend three consecutive meetings and any vacancies which shall occur by such removal or by death or resignation shall be filled up by the said Council.
3. It shall be the duty of the Board when requested by the Clergyman in Charge and Managing Body of any Parish or Parochial District to further the establishment of Primary and Secondary Church Schools within such Parish or Parochial District and to afford information in respect of duly qualified teachers.
4. The Board shall be empowered to authorise the establishment of Schools within the Diocese under the name of Parochial Church Schools upon the following conditions:
(1) The management of each such School shall be vested in a School
Committee consisting of:
(a) The Bishop as President (ex officio).
(b) The Clergyman in Charge of the Parish or Parochial District in which the School is situated as Vice-President (ex officio).
(c) Six other members of the Anglican Church of Australia two of whom shall
be elected by the Governors if any of the School two by
the Managing Body or
Bodies in the Parochial District in which the School is situated and two by the
Board of Education. In the event
of no appointment having been made by the
Governors or the Board of Education on or before the thirty-first day of January
in each
year the Managing Body or Bodies of the Parish or Parochial District may
fill the vacancies in such Committee Three Members of the
Committee shall form a
quorum.
(2) All School properties shall be vested in the Ballarat Diocesan
Trustees.
(3) A Donor of $100 shall be a Governor for life and a contributor of $10
shall be a Governor for the year in which he so contributes.
(4) Religious instruction shall subject to a conscience clause be given in every School in accordance with the principles of the Anglican Church of Australia and prayers shall be said daily at the commencement and close of work.
(5) The Head Master or Head Mistress in each School shall be a member
of the Anglican Church of Australia.
5. The Board shall draw up a model Constitution for Parochial Church & Schools which shall embody the essential conditions of Section 4 hereof.
6. This Act shall not be construed or deemed to have any retrospective effect in regard to Church Schools under agreement with the Bishop or Bishop-in-Council prior to the passing hereof nor shall it apply to any Church School that may hereafter be established in the Diocese in pursuance of any special Act of Synod.
