No. 1, 1942
AN ACT
TO PROVIDE FOR THE RETIREMENT OF
BISHOPS
Affected by: Act No. 2, 1974-1993
BE it enacted by the
Bishop the Clergy and the Laity of the Church of England within the Diocese of
Wangaratta duly met in Synod according
to law as follows:-
Repeal
1. Act No. 1, 1923 shall be and the same is hereby repealed.
Retirement at
70 years
2. (a) Save as hereinafter provided when a Bishop shall attain the age of 70
years he shall retire from his office as Bishop of the
Diocese and his attaining
such age shall create a vacancy in the See.
Retirement may
be
postponed
(b) The Board of Electors for the election of a Bishop in case of a vacancy
in the See may at any time within six months before
the Bishop attains the said
age invite the Bishop to continue as Bishop for a further period not exceeding
two years and in that
case paragraph (a) of this section shall for such period
be deemed inoperative.
(c) The said period of two years may be extended by the Board of Electors
from time to time for a further period or periods not
exceeding two years' each
on the same conditions.
(d) For the purposes aforesaid the Board of Electors may meet independently
of the Bishop on being summoned in writing by the Vicar-General
or by any three
of its members.

3. The Council of the Diocese may from time to time make such payments from the Diocesan Fund as it may see fit towards ensuring suitable provision for the Bishop on his retirement or for his dependents.
