PARLIAMENT OF VICTORIA Introduced in the Council by Ms Georgie Crozier Children, Youth and Families Amendment (Youth Offenders) Bill 2016 A Bill for an Act to amend the Children, Youth and Families Act 2005 to provide for the safety and protection of the community in the administration of the youth parole system and for other purposes. The Parliament of Victoria enacts: 1 Purposes The principal purposes of this Act are to amend the Children, Youth and Families Act 2005-- (a) to require the Youth Parole Board to give 5 paramount consideration to the safety and protection of the community when making decisions relating to parole; and 581PM18B.I-6/12/2016 1 BILL LC INTRODUCTION 6/12/2016

 


 

Children, Youth and Families Amendment (Youth Offenders) Bill 2016 (b) to require the Youth Parole Board to include in its annual report the number of persons who have committed serious offences while released on parole. 5 2 Commencement (1) Subject to subsection (2), this Act comes into operation on a day or days to be proclaimed. (2) If a provision of this Act does not come into operation before 1 July 2017, it comes into 10 operation on that day. 3 Reports by Youth Parole Board (1) After section 452(1)(ab) of the Children, Youth and Families Act 2005 insert-- "(ac) the number of persons convicted during that 15 period of a serious offence committed while released on parole by the Board; and". (2) After section 452(4) of the Children, Youth and Families Act 2005 insert-- "(5) In this section-- 20 serious offence has the same meaning as in section 72 of the Corrections Act 1986.". 4 New section 458A inserted After section 458 of the Children, Youth and 25 Families Act 2005 insert-- "458A Safety and protection of the community paramount in parole decisions The Youth Parole Board must give paramount consideration to the safety and 30 protection of the community in determining whether-- (a) a person is to be released on or granted parole; or 581PM18B.I-6/12/2016 2 BILL LC INTRODUCTION 6/12/2016

 


 

Children, Youth and Families Amendment (Youth Offenders) Bill 2016 (b) to revoke a parole order; or (c) to amend or vary the terms and conditions to which a parole order is subject.". 5 5 Repeal of amending Act This Act is repealed on 1 July 2018. Note The repeal of this Act does not affect the continuing operation of the amendments made by it (see section 15(1) of the 10 Interpretation of Legislation Act 1984). ═══════════════ 581PM18B.I-6/12/2016 3 BILL LC INTRODUCTION 6/12/2016
