Planning and Environment Amendment
(Schools) Bill 2011
A Bill for an Act to amend the Planning and Environment Act 1987
and for other purposes.
The Parliament of Victoria enacts:
1 Purpose
The purpose of this Act is to amend the Planning
and Environment Act 1987 to provide that
subdivisions of, and building work relating to,
5 land used or to be used for schools will not give
rise to liability to pay growth areas infrastructure
contributions.
2 Commencement
This Act comes into operation on the day after the
10 day on which it receives the Royal Assent.

3 Definitions in Part 9B
See: In section 201R of the Planning and
Act No.
45/1987. Environment Act 1987 insert the following
Reprint No. 9 definitions--
as at
5 27 May 2010
and
"construction has the meaning that it has in the
amending Building Act 1993;
Act Nos
6/2010, school has the same meaning as in section 1.1.3 of
23/2010,
58/2010, the Education and Training Reform Act
29/2011 and 2006;".

10 4 Excluded subdivisions of land
After section 201RF(b) of the Planning and
Environment Act 1987 insert--
"(ba) the purpose of the subdivision is solely to
provide a lot for a school or a proposed
15 school; or".
5 Excluded building work
After section 201RG(1)(c) of the Planning and
Environment Act 1987 insert--
"(ca) building work relating to a school or
20 proposed school including purposes ancillary
to a school; or".
6 Repeal of amending Act
This Act is repealed on the first anniversary of its
commencement.
25 Note
The repeal of this Act does not affect the continuing operation of
the amendments made by it (see section 15(1) of the
Interpretation of Legislation Act 1984).
