PARLIAMENT OF VICTORIA Introduced in the Assembly Statute Law Amendment (Charter of Human Rights and Responsibilities) Bill 2009 A Bill for an Act to make amendments to various Acts to ensure compatibility with the Charter of Human Rights and Responsibilities and for other purposes. Statute Law Amendment (Charter of Human Rights and Responsibilities) Bill 2009 Part 2--Amendments to the Australian Grands Prix Act 1994 s. 3 PART 2--AMENDMENTS TO THE AUSTRALIAN GRANDS PRIX ACT 1994 3 Regulations In sections 51(5)(a) and 51(5)(b) of the See: Act No. 5 Australian Grands Prix Act 1994 for "proof" 68/1994. substitute "evidence". Statute Law Amendment (Charter of Human Rights and Responsibilities) Bill 2009 Part 3--Amendments to Education and Training Reform Act 2006 s. 5 PART 3--AMENDMENTS TO EDUCATION AND TRAINING REFORM ACT 2006 5 Saving of rights of persons holding Government office 5 See: (1) In section 2.4.31(2) of the Education and Act No. 24/2006. Statute Law Amendment (Charter of Human Rights and Responsibilities) Bill 2009 Part 3--Amendments to Education and Training Reform Act 2006 s. 6 (3) After section 2.4.31(3) of the Education and Training Reform Act 2006 insert-- "(4) A person may apply to a Merit Protection Board for a review of a decision by the 5 Secretary to refuse to re-employ the person to an on-going position in the teaching service if-- (a) the person is not a member of the teaching service; and 10 (b) the grounds for the refusal are that the person does not possess the qualifications or experience required by a Ministerial Order necessary for re- employment to an on-going position in 15 the teaching service.". 6 New section 2.4.53A inserted After section 2.4.53 of the Education and Training Reform Act 2006 insert-- "2.4.53A Review of Secretary's decision not to 20 re-employ (1) If a Merit Protection Board receives an application under section 2.4.31(4), it must subject to and in accordance with the regulations inquire into and determine the 25 claim of the applicant. Statute Law Amendment (Charter of Human Rights and Responsibilities) Bill 2009 Part 4--Amendments to Fair Trading Act 1999 s. 7 PART 4--AMENDMENTS TO FAIR TRADING ACT 1999 7 Representations as to future matters See: (1) In section 4(2) of the Fair Trading Act 1999-- Act No. 16/1999. Reprint No. 3 (a) for "In" substitute "Subject to subsection 5 as at (2A), in"; 23 February 2007 (b) for "he or she" substitute "the person". and amending (2) After section 4(2) of the Fair Trading Act 1999 Act Nos 69/2006, insert-- 75/2006, 77/2006, "(2A) In any proceeding for an offence under this 17/2007, 10 2/2008, 6/2008, Act concerning a representation made by a 12/2008 and natural person about a future matter, the 2/2009. Statute Law Amendment (Charter of Human Rights and Responsibilities) Bill 2009 Part 4--Amendments to Fair Trading Act 1999 s. 9 9 New clause inserted in Schedule 3 At the end of Schedule 3 to the Fair Trading Act 1999 insert-- "15 Transitional--Statute Law Amendment 5 (Charter of Human Rights and Responsibilities) Act 2009 (1) Despite the commencement of section 7 of the Statute Law Amendment (Charter of Human Rights and Responsibilities) Act 10 2009, section 4(2) as in force immediately before that commencement continues to apply to proceedings for an offence that were commenced under section 4 but not completed before that commencement. 15 (2) Despite the commencement of section 8 of the Statute Law Amendment (Charter of Human Rights and Responsibilities) Act 2009, section 14(2) as in force immediately before that commencement continues to 20 apply to proceedings commenced under section 14 but not completed before that commencement.". __________________ 561230B.I-10/3/2009 7 BILL LA INTRODUCTION 10/3/2009
