ANZAC Day (Amendment) Bill Victorian Legislation and Parliamentary Documents Circulation Print EXPLANATORY MEMORANDUM General The purpose of the Bill is to amend the Anzac Day Act 1958 to recognise service by Australians in all conflicts, including peace-keeping activities, to make amendments to various Acts to refer to "ANZAC" to recognise the origins of that word and to increase penalties for offences under laws controlling activities on ANZAC Day. Clause Notes Clause 1 sets out the purposes of the Bill. Clause 2 provides for the Bill to come into operation on the day after it receives Royal Assent. Clause 3 defines the Principal Act as the Anzac Day Act 1958. Clause 4 substitutes the word "ANZAC" for "Anzac" in the short title in section 1 of the Principal Act. Clause 5 inserts the heading "Commemoration of ANZAC Day" into section 3 of the Principal Act and expands the reference to commemoration in section 3 of the Principal Act to include the service of Australians for their country in all conflicts and peace- keeping activities subsequent to World War I. It also replaces the word "Anzac" with "ANZAC" in that section. Clause 6 inserts the heading "Sports on ANZAC Day" to section 4 of the Principal Act and substitutes the word "ANZAC" for "Anzac" wherever it occurs in section 4. Clause 7 inserts the heading "ANZAC Day Proceeds Fund" to section 4A of the Principal Act and substitutes the word "ANZAC" for "Anzac" wherever it occurs in section 4A. 1 551095 BILL LA CIRCULATION 31/10/2003
Clause 8 substitutes the word "ANZAC" for "Anzac" in the heading to section 5 and in section 5(1) of the Principal Act and increases the penalty for all breaches of the provisions relating to use of Victorian Legislation and Parliamentary Documents cinemas on ANZAC Day from 5 penalty units to 100 penalty units. Clause 9 substitutes the word "ANZAC" for "Anzac" in the heading to section 5A and in section 5A(1) and section 5A(3)(b) of the Principal Act and increases the penalty for all breaches of the provisions relating to other entertainment on ANZAC Day from 5 penalty units to 100 penalty units. Clause 10 inserts a new section 7 into the Principal Act to deem the ANZAC Day Proceeds Fund to be the same fund as it was before the commencement of the ANZAC Day (Amendment) Act 2003. Clause 11 inserts a note at the end of the Principal Act after the current Schedule identifying other Acts which also contain references to ANZAC Day. Clause 12 repeals the Theatres (Repeal) Act 2002 as the amendments it made have occurred, making that Act redundant. Clause 13 substitutes the word "ANZAC" for "Anzac" wherever it occurs in the Labour and Industry Act 1958. Clause 14 substitutes the word "ANZAC" for "Anzac" wherever it occurs in the Liquor Control Reform Act 1998. Clause 15 inserts the heading "Two-up may be played on ANZAC Day" into section 11A of the Lotteries Gaming and Betting Act 1966 and substitutes the word "ANZAC" for "Anzac" wherever it occurs in the Lotteries Gaming and Betting Act 1966. Clause 16 substitutes the word "ANZAC" for "Anzac" wherever it occurs in the Public Holidays Act 1993. Clause 17 substitutes the word "ANZAC" for "Anzac" wherever it occurs in the Racing Act 1958 and inserts new headings to section 22A and section 63A of the Racing Act 1958. Clause 18 substitutes the word "ANZAC" for "Anzac" wherever it occurs in the Shop Trading Reform Act 1996. 2
