Cancer Amendment (HPV) Bill 2008 Introduction Print EXPLANATORY MEMORANDUM General This Bill amends the Cancer Act 1958 by extending the definition of "cancer test" in section 59(1) to include a test for a precursor to cancer. This amendment will enable reports of tests for precursors to cancer, such as the human papilloma virus, to be forwarded to an organisation that maintains a prescribed register. Clause Notes Clause 1 sets out the main purpose of the Act. Clause 2 is the commencement provision. It provides for the Act to come into operation on the day after the day on which it receives the Royal Assent. Clause 3 amends the definition of "cancer test" in section 59(1) of the Cancer Act 1958 to include a test for a precursor to cancer. Clause 4 ensures that references to "cancer" in sections 62(4), 62(5)(c) and 62(9)(b) of the Cancer Act 1958 also apply to "precursors to cancer". The amendment to section 62(4) of the Cancer Act 1958 makes it clear that persons undergoing cancer tests specifically in relation to precursors to cancer are able to object to a report being forwarded under section 62 of the Cancer Act 1958. The amendment to section 62(5)(c) of the Cancer Act 1958 ensures that persons studying precursors to cancer are given access to the prescribed register under section 62(5). The amendment to section 62(9)(b) of the Cancer Act 1958 confirms that the regulation-making power of the Governor in Council with respect to access to a prescribed register by persons studying cancer also extends to persons studying precursors to cancer. 561179 1 BILL LA INTRODUCTION 15/4/2008
Clause 5 provides that this Act is repealed on the first anniversary of its commencement. The repeal of this Act does not affect in any way the operation of the amendments made by this Act (see section 15(1) of the Interpretation of Legislation Act 1984). 2
