                 EXPLANATORY MEMORANDUM


                                    General
The Bill amends the Casino Management Agreement Act 1993 and the
Casino Control Act 1991--
         ·      to abolish the health benefit levy; and
         ·      to ratify the ninth Deed of Variation to the management
                agreement for the Melbourne Casino to more closely align the
                rate of taxation that applies to gaming machine revenue in
                Victoria between the casino and other gaming venues through
                imposing additional taxes on the casino's gaming machines.

                                 Clause Notes

                        PART 1--PRELIMINARY
Clause 1      outlines the main purposes of the Bill.

Clause 2      provides that the proposed Act come into operation on the day
              after the day on which it receives Royal Assent.

               PART 2--CASINO CONTROL ACT 1991
Clause 3      provides for the abolition of the Health Benefit Levy by repealing
              section 114A and 114B of the Casino Control Act 1991.
              The date of repeal is 1 July 2012.

Clause 4      amends section 116 of the Casino Control Act 1991 to remove
              redundant references to the health benefit levy.

PART 3--CASINO (MANAGEMENT AGREEMENT) ACT 1993 Clause 5 amends the definitions in section 4 of the Casino (Management Agreement) Act 1993 as a result of the inclusion of a Ninth Deed of Variation. Clause 6 inserts a new section 6I into the Casino (Management Agreement) Act 1993. Subsection (1) ratifies the ninth Deed of Variation to the Casino Management and provides that it takes effect as if enacted in that Act. Subsection (2) provides that the Agreement is amended as provided in the ninth Deed of Variation. Subsection (3) provides that a reference in clause 2.2 of the ninth Deed of Variation to the coming into operation of the Bill is a reference to the commencement of Part 3 of the Casino Legislation Amendment Act 2009. Clause 7 amends section 7(2) of the Casino (Management Agreement) Act 1993 to add a reference to new section 6I to ensure that section 7(1) (which provides that a provision of the Casino Management Agreement prevails over the Casino Control Act 1991), does not derogate from the operation of new section 6I. Clause 8 inserts a new Schedule 10 into the Casino (Management Agreement) Act 1993 which sets out the Ninth Deed of Variation to the Casino Management Agreement. Clause 9 provides for the automatic repeal of the Bill on 1 July 2013. The repeal will not affect the operation of the amendments to be made by the Bill (see section 15(1) of the Interpretation of Legislation Act 1984). 2
