Health Services Amendment (Health Purchasing Victoria) Bill 2012 Introduction Print EXPLANATORY MEMORANDUM General The Bill amends the Health Services Act 1988 to expand the range of health or related services in relation to which Health Purchasing Victoria performs functions and exercises powers to include registered community health centres and women's health services. Clause Notes Clause 1 sets out the purpose of the Bill. The purpose of the Health Services Amendment (Health Purchasing Victoria) Bill 2012 is to expand the range of health or related services in relation to which Health Purchasing Victoria performs functions and exercises powers to include registered community health centres and women's health services. Clause 2 is the commencement provision. The provisions will come into effect on the day after the day on which the Health Services Amendment (Health Purchasing Victoria) Bill 2012 receives Royal Assent. Clause 3 inserts new paragraphs (ab) and (ac) into the definition of health or related service in section 3(1) of the Health Services Act 1988. By new paragraph (ab), registered community health centres are included in the definition of health or related service. By new paragraph (ac), women's health services are included in the definition of health or related service by reference to new Schedule 6. 571323 1 BILL LA INTRODUCTION 27/11/2012
Registered community health centres are regulated by Division 6 of Part 3 of the Act. There are currently 38 registered community health centres in Victoria, 22 being located in metropolitan Melbourne and the remaining 16 being located in rural Victoria. There are 11 women's health services listed in new Schedule 6. The effect of this amendment will be to enable Health Purchasing Victoria to perform functions and exercise powers in relation to registered community health centres and women's health services in the same way it does in relation to all health or related services (other than public hospitals). For example, registered community health centres and women's health services will be able to access common use contracts for the supply of goods and services facilitated by Health Purchasing Victoria. Clause 4 inserts new Schedule 6 into the Health Services Act 1988. Schedule 6 lists the 11 women's health services. Clause 5 provides for the automatic repeal of this amending Act on the first anniversary of its commencement. The repeal of this Act does not affect in any way the continuing operation of the amendments made by this Act (see section 15(1) of the Interpretation of Legislation Act 1984). 2
