               EXPLANATORY MEMORANDUM


                                   General
The purpose of the Bill is to dismiss the Glen Eira City Council and set a date
for a general election and to amend the Local Government Act 1989 to
allow an order for the suspension of the councillors of a Council to expire at
the end of a specified period that is less than one year.

                                Clause Notes
Clause 1    sets out the purpose of the Bill which is to dismiss the Glen Eira
            City Council, provide for the expiry of the Order in Council that
            applies to that Council and for a general election for the Glen
            Eira City Council and to amend section 219 of the Local
            Government Act 1989.

Clause 2    provides for the Bill to come into operation on the day it receives
            Royal Assent.

Clause 3    requires that the Bill must be read and construed as if it formed
            part of the Local Government Act 1989.

Clause 4    defines "general election" and "Order in Council".

Clause 5    provides for the Glen Eira City Council to be dismissed and for
            the continuity of the administrator appointed under the Order in
            Council.

Clause 6    specifies that the general election for the Glen Eira City Council
            must be held on 26 November 2005.

Clause 7    specifies that the entitlement date for the general election is
            7 October 2005.

Clause 8    specifies that certain provisions of the Local Government Act
            1989 relating to the preparation of an exhibition roll do not apply
            to the general election.

Clause 9 provides for the preparation of a list of people who appear to be entitled to be enrolled and for that list to be available for public inspection for five days up to the entitlement date and for a person to object to a record on the list. Clause 10 amends the application of section 24 of the Local Government Act 1989 to provide for a voters roll to be prepared for the general election. Clause 11 specifies that the validity of the voters' roll is not affected by any action or inaction by the administrator appointed under the Order in Council. Clause 12 requires the Chief Executive officer to summon a meeting of the Council within 14 days of the declaration of the election result. Clause 13 specifies that the Order in Council expires when the meeting specified in section 12 starts and states that sections 219(9) to 219(12) of the Local Government Act 1989 do not apply in respect of the Order in Council. Clause 14 amends section 219(7) of the Local Government Act 1989 to provide that an Order in Council to suspend all the councillors of a council may expire on a date specified in the Order that is less than one year after the date the Order is published. 2
