Nurses (Amendment) Bill Victorian Legislation and Parliamentary Documents Circulation Print EXPLANATORY MEMORANDUM Clause Notes Clause 1 sets out the purposes of the Act. Clause 2 provides that the Act comes into operation after the day on which it receives Royal Assent. provides that in the Act, the Nurses Act 1993 is called the Clause 3 Principal Act. Clause 4 amends the definition of "endorsement" in the Principal Act. Clause 5 inserts a new section 8C into the Principal Act which allows the Board to endorse the registration of a nurse registered under division 2 of the register if the Board is satisfied that the nurse has completed an approved course of study in medication administration or its equivalent. Clause 6 amends the Principal Act to provide that the Board must notify an applicant for endorsement of registration under section 8C of the outcome of the application. Clause 7 inserts a new sub-section (1C) into section 13 of the Principal Act which provides for the renewal of an endorsement of registration under new section 8C. Clause 8 inserts new sub-sections (3) and (4) into section 14 of the Principal Act which allows the Board to refuse to renew the endorsement of registration under section 8C of an applicant if the Board is satisfied that the applicant for renewal has not maintained the required competencies in medication administration for that endorsement. A nurse may make submissions on such a refusal. Clause 9 makes a consequential amendment to section 15 of the Principal Act (which deals with the effect of suspension) so that it also applies to a nurse whose registration is endorsed under section 8C. 1 551135 BILL LA CIRCULATION 27/11/2003
Clause 10 makes consequential amendments to sections 17, 18 and 19 of the Principal Act, which deal with matters related to the register and certificates of registration, so that they also apply to registrations Victorian Legislation and Parliamentary Documents that have been endorsed under section 8C. Clause 11 inserts new offences into the Principal Act which prohibit persons or nurses from claiming to be endorsed under section 8C. The clause also inserts offences that prohibit nurse agencies from arranging for a nurse whose registration is not endorsed under section 8C to work in contravention of the terms of that nurse's endorsement or to work as a nurse whose registration is endorsed under section 8C. Clause 12 amends section 66 of the Principal Act (which sets out the powers and functions of the Board) to provide that the Board may also approve courses of study that provide competence for which registration may be endorsed under section 8C and to determine the manner in which competencies for such endorsement may be maintained. 2
