Parliamentary Legislation Amendment Bill 2007 Introduction Print EXPLANATORY MEMORANDUM Clause Notes PART 1--PRELIMINARY Clause 1 provides that the purpose of the Act is to amend the Parliamentary Committees Act 2003 to rename the Economic Development Committee and alter its functions; to rename the Rural and Regional Services and Development Committee; and to increase the maximum number of members of a Joint Investigatory Committee. The Act also amends the Parliamentary Salaries and Superannuation Act 1968 to provide for additional salary payable to certain Members of Parliament. Clause 2 provides that the proposed Act will commence operation on the day after the day on which it receives Royal Assent. PART 2--PARLIAMENTARY COMMITTEES ACT 2003 Clause 3 amends section 5 of the Parliamentary Committees Act 2003 to provide for the renaming of two Joint Investigatory Committees. Clause 4 amends section 8 of the Parliamentary Committees Act 2003 to provide that the Economic Development and Infrastructure Committee has the additional function of inquiring into, considering and reporting to the Parliament on any proposal, matter or thing concerned with infrastructure. Clause 5 amends section 16 of the Parliamentary Committees Act 2003 to change references to the Rural and Regional Services and Development Committee to the Rural and Regional Committee. 561007 1 BILL LA INTRODUCTION 14/2/2007
Clause 6 amends section 21(1) of the Parliamentary Committees Act 2003 to increase the maximum number of members of a Joint Investigatory Committee from 9 to 10. Clause 7 inserts a new section 66 into the Parliamentary Committees Act 2003. Section 66 provides that the successor committees specified in the Table can consider evidence that was obtained by the specified former committees where the term of that former committee has ended and that committee has not yet tabled a report to Parliament. Clause 8 repeals Part 7 of the Parliamentary Committees Act 2003 for the purposes of making statute law revisions which remove references to defunct legislation. PART 3--PARLIAMENTARY SALARIES AND SUPERANNUATION ACT 1968 Clause 9 amends section 6 of the Parliamentary Salaries and Superannuation Act 1968 to delete the requirement that the Leader of the Third Party in the Legislative Council must have at least 4 members of that party as Members of the Legislative Council to qualify for the prescribed Additional Salary. This clause amends section 6 to change the Additional Salary payable to the Chairperson of the Public Accounts and Estimates Committee to 20% of his or her basic salary, and the Additional Salary payable to the Chairperson of the Scrutiny of Acts and Regulations Committee to 15% of his or her basic salary. This clause amends section 6 to ensure that the Chairpersons of all other Joint Investigatory Committees, other than the Public Accounts and Estimates Committee and the Scrutiny of Acts and Regulations Committee, continue to be entitled to an Additional Salary of 10% of each of their basic salaries. This clause amends section 6 to provide that the Deputy Chairpersons of the Public Accounts and Estimates Committee and the Scrutiny of Acts and Regulations Committee are each entitled to an Additional Salary of 4% of his or her basic salary. 2
PART 4--REPEAL OF AMENDING ACT Clause 10 provides for the automatic repeal of this amending Act on the first anniversary of its commencement. As suggested by the Scrutiny of Acts and Regulations Committee, all amending Acts now contain an automatic repeal provision, which will save the time and expense of having to repeal amending Acts in statute law revision Bills. The repeal of this Act does not affect in any way the operation of the amendments made by this Act (see section 15(1) of the Interpretation of Legislation Act 1984). 3
