Parliamentary Salaries and Superannuation Amendment (Salary Restraint) Bill 2012 Introduction Print EXPLANATORY MEMORANDUM Clause Notes Clause 1 provides that the purpose of the proposed Act is to amend the Parliamentary Salaries and Superannuation Act 1968 to limit the increase in the salary that would otherwise be payable to members of the Parliament of Victoria to 2·5% for the 2012-2013 financial year. Clause 2 provides for the commencement of the proposed Act. The proposed Act will come into operation on 1 July 2012. Clause 3 inserts section 3B of the Parliamentary Salaries and Superannuation Act 1968 to put in place a different definition of basic salary for the financial year commencing 1 July 2012. Section 3 defines basic salary to mean the amount of the annual allowance by way of salary from time to time payable to Members of the House of Representatives under the law of the Commonwealth less $5733. The new section 3B will mean that, for the period 1 July 2012 to 30 June 2013, the new basic salary will be set as the basic salary on 30 June 2012 increased by 2·5%. The basic salary on 30 June 2012 is determined in accordance with section 3A, which provides that the basic salary on 30 June 2012 is the basic salary on 30 June 2011 increased by 2·5%. 571297 1 BILL LA INTRODUCTION 1/5/2012
Clause 4 repeals the proposed Act on 1 July 2013. In accordance with section 15(1) of the Interpretation of Legislation Act 1984, the repeal does not affect the continuing operation of the amendments made by the Act. 2
