                                                                   EXPLANATORY MEMORANDUM


                                                                                       General
                                                    The purpose of the Bill is to provide for the development and implementation
                                                    of a Victorian Industry Participation Policy and require reports to Parliament
                                                    on the policy's implementation and government agencies' compliance with it.

                                                                                    Clause Notes
                                                    Clause 1    sets out the purpose of the Bill, as described above.

                                                    Clause 2    provides for the Bill to come into operation on a day or days to
                                                                be proclaimed, but no later than 1 January 2004.

                                                    Clause 3    defines the following terms--
                                                                  ·      "agency" (being departments and public bodies under
                                                                         the Financial Management Act 1994);
                                                                  ·      "Department" (being the Department of Innovation,
                                                                         Industry and Regional Development);
                                                                  ·      "local industry" (being Australian and New Zealand
                                                                         industry);
                                                                  ·      "VIPP" (being the Victorian Industry Participation
                                                                         Policy).

                                                    Clause 4    requires the Government to develop and implement the VIPP and
                                                                notes that the detail of it may be contained in separate guidelines.

                                                    Clause 5    sets out the objectives of the VIPP, which include the promotion
                                                                of employment and business growth, increased access to, and
                                                                raised awareness of, local suppliers, exposing local businesses to
                                                                world's best practice and developing local industry's international
                                                                competitiveness.

Clause 6 outlines the principles of the VIPP in relation to government purchasing and government tendering mechanisms including value for money as the primary consideration. Victorian Legislation and Parliamentary Documents Clause 7 requires the VIPP to be consistent with other legislative requirements including supply policies under the Financial Management Act 1994 and standards and directions under the Project Development and Construction Management Act 1994, and any obligations the State has in relation to conventions, treaties or other international agreements to which Australia is party. Clause 8 specifies that the VIPP (including the guidelines) must be published in hard copy and electronic form and must be freely available. Clause 9 outlines the requirement for each agency to include in its report of operations the agency's compliance with the VIPP in the financial year and allows details of reporting requirements to be contained in directions issued under section 8 of the Financial Management Act 1994. Clause 10 provides for the Minister to report to Parliament before 30 November each year on the implementation of the VIPP in the previous financial year. Clause 11 requires agencies to provide the Minister with information so that the Minister can comply with clause 10. 2
