Victorian Current Acts Victorian Current Acts(1) The amendments made to Part IV by Part 3 of the amending Act do not apply in respect of an injury that occurred before the commencement of Part 3, and Part IV applies in respect of such an injury as if those amendments had not been made.
(2) If the death of a worker results from both an injury that occurred before the date of commencement of Part 3 of the amending Act and an injury that occurred on or after that date, the worker is, for the purposes of the application of the amendments made by Part 3 of that Act to and in respect of the death of the worker, to be treated as having died as a result of the injury that occurred on or after that date.
(3) If a period of incapacity for work resulted both from an injury that occurred before the date of commencement of Part 3 of the amending Act and an injury that occurred on or after that date, the incapacity is, for the purposes of the application of the amendments made by Part 3 of that Act to and in respect of that incapacity for work, to be treated as having resulted from the injury that occurred on or after that date.
(4) The amendments made by Part 3 of the amending Act and subsections (2) and (3) do not affect the apportionment of liability in a case where one or more of the injuries concerned occurred before, and one or more occurred on or after, the date of commencement of Part 3.
