APPEAL COSTS ACT 1998 - SECT 28

Meetings

S. 28(1) amended by No. 38/2017 s. 25(1).

    (1)     The chairperson (or in the chairperson's absence, the deputy chairperson) must preside at a meeting of the Board.

    (2)     A majority of the members for the time being holding office constitutes a quorum of the Board.

    (3)     If there is a quorum at a meeting of the Board, the Board may act despite any vacancy in its membership.

    (4)     Subject to subsection (5), a matter arising at a meeting of the Board is determined by a majority of votes and the chairperson (or in the chairperson's absence, the deputy chairperson) has a deliberative vote and, in the case of an equality of votes, a second or casting vote.

    (5)     If at any meeting of the Board at which 2 members only are present, those members differ in opinion on a matter, the determination of that matter must be postponed to the next meeting of the Board at which more than 2 members are present.

    (6)     The Board must ensure that accurate minutes are kept of its meetings.

    (7)     Subject to this Part and the regulations, the Board may—

        (a)     conduct its meetings in any manner it thinks fit; and

        (b)     regulate its own proceedings.
