Victorian Current Acts Victorian Current Acts(1) A responsible entity must not, without reasonable excuse, fail to comply with any requirement of the CERCC Plan that is in force.
Penalty: In the case of a natural person, 120 penalty units;
In the case of a body corporate, 600 penalty units.
(2) Subsection (1) is a civil penalty provision.
(3) The responsible entity must not, without reasonable excuse, fail to notify the Head, Recycling Victoria as soon as reasonably practicable after becoming aware that the responsible entity is unable to comply with a requirement of the CERCC Plan.
Penalty: In the case of a natural person, 120 penalty units;
In the case of a body corporate, 600 penalty units.
(4) Subsection (3) is a civil penalty provision.
