COUNTRY FIRE AUTHORITY ACT 1958 - SECT 41D

Compliance with notices

S. 41D(1) amended by No. 5/2012 s. 32.

    (1)     Subject to sections 41B and 41C, a person on whom a fire prevention notice has been served must comply with the notice.

Penalty:     120 penalty units or imprisonment for 12 months or both.

    (2)     Proceedings for an offence under subsection (1) may be taken—

        (a)     by a police officer;

S. 41D(2)(b) amended by No. 9/2020 s. 390(Sch.  1 item 18.1).

        (b)     if the fire prevention notice was served by a fire prevention officer, in accordance with section 313 of the Local Government Act 2020 ;

        (c)     if the fire prevention notice was served by the Chief Officer, by a person appointed for the purpose by the Chief Officer.
