CRIMES (MENTAL IMPAIRMENT AND UNFITNESS TO BE TRIED) ACT 1997 - SECT 90

International forensic patient—transitional provision

A person who, immediately before 1 July 2014, is—

        (a)     not subject to a hospital transfer order or a restricted hospital transfer order under section 16(3) of the Mental Health Act 1986 (as in force immediately before 1 July 2014); and

        (b)     serving a sentence of imprisonment within the meaning of the International Transfer of Prisoners Act 1997 of the Commonwealth at an approved mental health service—

is taken on 1 July 2014 to be received at a designated mental health service as an international forensic patient.
