CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 241

Protective intervener may place child in need of protection in emergency care

    (1)     If a protective intervener is satisfied on reasonable grounds that a child is in need of protection and that it is inappropriate to take the procedure set out in section 240(1)(a), he or she may—

S. 241(1)(a) amended by No. 52/2013 s. 26(2)(a).

        (a)     without a warrant, place the child in emergency care or cause another protective intervener to place the child in emergency care; or

S. 241(1)(b) amended by No. 52/2013 s. 26(2)(b).

        (b)     apply to a magistrate for the issue of a search warrant for the purpose of having the child placed in emergency care.

    (2)     A search warrant issued under subsection (1)—

S. 241(2)(a) amended by No. 37/2014 s. 10(Sch. item 18.9).

        (a)     may only be directed to a named police officer or generally all police officers; and

        (b)     may be endorsed by the person issuing it with a direction that the child be released on an interim accommodation order of the type referred to in section 263(1)(a) or 263(1)(b) as specified in the endorsement.
