CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 256

Extension of order

    (1)     If an application is made under section 255 to extend a therapeutic treatment order, the Court may extend the order for a period not exceeding 12 months if it is satisfied that the child is still in need of therapeutic treatment.

    (1A)     Subsection (1) applies even if the child has attained the age of 18 years before the therapeutic treatment order is extended or will attain the age of 18 years during the period of extension.

    (2)     If an application is made under section 255 to extend a therapeutic treatment (placement) order, the Court may extend the order for a period not exceeding the period of the therapeutic treatment order to which it relates if the Court is satisfied that the therapeutic treatment (placement) order is still necessary for the therapeutic treatment of the child.

    (3)     The Court must not extend an order under this section unless the Court is satisfied that therapeutic treatment is still available for the child.

    (4)     Despite the extension of a therapeutic treatment (placement) order under this section, the therapeutic treatment (placement) order ceases to be in force if the child attains the age of 18 years or marries, whichever happens first.
