CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 44

Departmental community services and secure welfare services

    (1)     The Governor in Council may, by Order published in the Government Gazette—

        (a)     establish to be operated by the Department to meet the needs of children requiring protection, care or accommodation—

              (i)     a service as a community service; or

        (ia)     a service as an out of home care service; or

              (ii)     a service with lock-up facilities as a secure welfare service; or

        (b)     abolish a service referred to in paragraph (a).

    (2)     If a service is established as a community service under subsection (1)(a)(i), the Order must specify the prescribed class of community service to which that community service belongs.
