CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 525

Proceedings in which child is required to be legally represented

S. 525(1) amended by No. 15/2013 s. 11.

    (1)     Subject to section 524, a child aged 10 years or more must be legally represented in the following proceedings in the Family Division

        (a)     application for an interim accommodation order;

        (b)     protection application;

        (c)     irreconcilable difference application;

        (d)     application for a temporary assessment order, (unless the Court grants leave for the application to proceed without notice to the other parties);

        (e)     application for—

              (i)     a therapeutic treatment order; or

              (ii)     a therapeutic treatment (placement) order;

        (ea)     application under section 289(1A) for a care by Secretary order; or

S. 525(1)(eb) inserted by No. 8/2016 s. 22(5).

        (eb)     application under section 290(1A) for a long‑term care order; or

        (f)     application for a permanent care order;

        (g)     application for the variation of an interim accommodation order;

        (h)     application for the variation or revocation of—

              (i)     a temporary assessment order; or

              (ii)     a therapeutic treatment order; or

              (iii)     a therapeutic treatment (placement) order; or

              (iv)     a family preservation order; or

              (v)     family reunification order; or

              (vi)     a permanent care order;

              (i)     application in respect of a failure to comply with—

              (i)     an interim accommodation order; or

              (ii)     a family preservation order;

S. 525(1)(j) substituted by No. 61/2014 s. 86(1).

        (j)     application for the extension of—

              (i)     a family preservation order; or

              (ii)     a family reunification order; or

              (iii)     a care by Secretary order;

S. 525(1)(k) substituted by No. 61/2014 s. 86(1).

        (k)     application for the revocation of—

              (i)     a care by Secretary order; or

              (ii)     a long-term care order;

S. 525(1)(l) amended by No. 61/2014 s. 86(2).

        (l)     application for an order regarding the exercise of any right, power or duty vested in a person with joint parental responsibility for a child;

        (m)     application for an order transferring a child protection order within the meaning of Schedule 1 to a participating State within the meaning of that Schedule;

        (n)     application for an order transferring a child protection proceeding within the meaning of Schedule 1 to the Children's Court in a participating State within the meaning of that Schedule;

        (o)     application for the revocation of the registration of a document filed under clause 19 of Schedule 1.

    (2)     Subject to section 524, a child must be legally represented in the following proceedings in the Criminal Division

        (a)     proceeding with respect to bail if the informant or prosecutor or any person appearing on behalf of the Crown intends to oppose the grant of bail;

        (b)     proceeding under section 24 of the Bail Act 1977 ;

        (ba)     proceeding or investigation under Part 5A of the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997 ;

S. 525(2)(bb) inserted by No. 21/2016 s. 20.

        (bb)     proceeding under Part 4A of the Sex Offenders Registration Act 2004 ;

        (c)     hearing of a charge for an offence punishable, in the case of an adult, by imprisonment;

        (d)     review of a monetary penalty imposed by the Court in respect of an offence punishable, in the case of an adult, by imprisonment;

        (da)     proceedings in respect of varying a youth control order to make the order more restrictive or revoking a youth control order;

S. 525(2)(e) amended by No. 43/2017 s. 17(2).

        (e)     application in respect of a breach of an accountable undertaking, bond, probation order, youth supervision order, youth attendance order or youth control order imposed by the Court in respect of an offence punishable, in the case of an adult, by imprisonment.
