CHILDREN, YOUTH AND FAMILIES ACT 2005 - SECT 589

Rules of court

The President together with 2 or more magistrates for the Court may jointly make rules of court for or with respect to—

S. 589(a) amended by No. 69/2009 s. 54(Sch. Pt 2 item 10).

        (a)     requirements for the purposes of Part IIA of the Evidence (Miscellaneous Provisions) Act 1958 for or with respect to—

              (i)     the form of audio visual or audio link;

              (ii)     the equipment, or class of equipment, used to establish the link;

              (iii)     the layout of cameras;

              (iv)     the standard, or speed, of transmission;

              (v)     the quality of communication;

              (vi)     any other matter relating to the link;

        (b)     applications to the Court under Division 2 or 3 of Part IIA of the Evidence (Miscellaneous Provisions) Act 1958 ;

S. 589(c) amended by Nos 69/2009 s. 54(Sch. Pt 2 item 10), 21/2016 s. 21(a).

        (c)     any matter relating to the practice and procedure of the Court under Part IIA of the  Evidence (Miscellaneous Provisions) Act 1958 ;

S. 589(ca) inserted by No. 38/2017 s. 64.

        (ca)     the return to the Court of warrants issued under this Act or issued by the Court under section 57 of the Magistrates' Court Act 1989 as applied by this Act;

S. 589(d) inserted by No. 21/2016 s. 21(b).

        (d)     any other matter or thing required or permitted by or under Part 4A of the Sex Offenders Registration Act 2004 to be dealt with by rules of court or otherwise necessary or required for the purposes of Part 4A of that Act.
