DISABILITY ACT 2006 - SECT 160

A resident detained in a residential treatment facility who is absent from the residential treatment facility without leave of absence or special leave of absence under this or any other Act may be apprehended at any time by—

S. 160(a) amended by No. 37/2014 s. 10(Sch. item 45.2).

        (a)     a police officer; or

S. 160(b) substituted by No. 9/2023 s. 121.

        (b)     the person in charge of the residential treatment facility; or

S. 160(c) inserted by No. 9/2023 s. 121.

        (c)     a person employed under the Public Administration Act 2004 who is authorised by the Secretary; or

S. 160(d) inserted by No. 9/2023 s. 121.

        (d)     a person of a prescribed class who is authorised by the Secretary—

for the purpose of being returned to the residential treatment facility.
